Legislation And Compliance
Both Kari's Law and the RAY BAUM'S Act were added to the Telecommunications Act of 1934. The Telecommunications Act of 1934 is part of the Code of Federal Regulations (CFR) and enforced by the Federal Communications Commission Public Safety and Homeland Security Bureau. Violations can result in heavy penalties and daily fines as set forth by the Commission in a Notice of Apparent Liability. The collection enforcement of these penalties and fines is handled by the United States Department of Justice.
Kari's Law
On December 1, 2013, the world tragically lost a loving, caring, mother of three; for myself, I lost a daughter that I loved dearly. While Kari's death should never have happened, that cannot be changed. Going forward, the best way I can celebrate my daughter's life, and honor her legacy, is to advocate for awareness so this NEVER happens again. NG911 carries with it the promise that will assure when a call for help is made, it's delivered to the proper 1st responder, and carries the relevant lifesaving data that can make a difference. Applies to all new systems, regardless of technology (including cloud-based systems) installed after February 16, 2020, or any system receiving a major upgrade after that date. Major upgrades are defined as 51% of the system hardware being refreshed, or a major software release. "Dot Releases" are not considered major releases. Version 7.X upgrading to version 8.X would be a major release, but version 7.2 upgrading to 7.4 would be considered a dot release and not be required to implement.

  • System must allow direct access to 911 without any access codes
  • System must provide on-site notification that the call has occurred and from what station.
  • On-site notification must be to a device on the premises, or another on site or offsite location.
The goal of this provision is to deliver more specific data that will enable public safety to reduce response times and raise situational awareness around emergency events.
RAY BAUM'S Act Section 506
Passed in 2018, the overall RAY BAUM's Act contains a myriad of communications and broadcast laws. Specific to MLTS environments, RAY BAUM'S Act Section 506 further codifies the Kari's Law requirements for access and adds the requirement that MLTS provide dispatchable location information on-site as well as delivering that information to the PSAP. The Act defines Dispatchable Location as: "... a location delivered to the PSAP with a 911 call that consists of the validated street address of the calling party, plus additional information."

Personal Liability for Wrongful Death
In addition to the fines and penalties, there is also a significant risk for personal wrongful death liability exposure to the MLTS owner operator. When Kari Hunt's family went to trial for Kari's murder, a Texas jury awarded the Hunt family $41 million for the wrongful death of Kari (Kari's Law was created after these tragic events). This was reportedly the very first time that a case of this type went to a jury trial, as other similar events ended up settling out of court where the award amounts were sealed and never made public

Each day, millions of employees spend their workday inside multistory buildings or facilities. Should an emergency occur, reaching the appropriate public safety agency quickly is essential. Aiding in the response is the action of the enterprise communication technology provider, typically the business employer. While many believe that sufficient location and calling abilities inherently exist, in most environments this is often a fallacy, and can have tragic results. Over the years, several different technologies have been deployed attempting to provide a solution, however in most cases, cost and complexity have created implementation challenges and roadblocks to a reasonable solution. In 2020, Next Generation 911 (NG911) networks and services have become a reality in many parts of the world, including the United States, Canada, Mexico, and as well as the European Union. In fact, the Canadian implementation of NG911 is well underway, with live traffic expected to traverse the network in the summer of 2021. Along with these NG911 services, comes the added benefit and ease of providing more relevant information regarding the location and environment directly from the originating device or network. Today, intelligent devices are connected to intelligent networks and can contribute discrete information about an event. New NG911 networks exist so that it can collect and deliver information to public safety agencies across North America. Not only does this new iteration of emergency communications facilitate the delivery of an emergency call to the appropriate 911 center, but it can also do so at a more affordable cost factor than traditional E911 solutions.
Why Next Generation 911?
Postal Service delivers package to recipientThe existing E911 network was designed and implemented well before the existence of IP telephony and multi-line telephone systems with advanced capabilities. The initial intent of the E911 network was to examine the origination location of the device based on its telephone number and then route that device to a predetermined PSAP for emergency services. At that time, telephone devices were static, and location changes were tracked and documented accurately. With the advent of IP telephony, as well as wireless telephony, devices became more nomadic. In this new nomadic device environment, moves and changes could not be processed quickly enough to maintain levels of location accuracy.

Next generation 911 networks provide the ability for originating networks, or intelligent devices to provide location information dynamically over a new IP transport layer that NG911 provided. In addition to the IP end points providing relevant information, the originating networks themselves, including the world of IOT devices they contained, could also contribute relevant information into the NG911 ecosystem.

Today, NG911 networks include RapidSOS's ADR (Additional Data Repository), which provide multimedia data transmissions to public safety. Currently, PSAPs enabled with the RapidSOS functionality covers 92% of the US population serving over 4,800 emergency communications centers across multiple countries and managing over 250 million emergencies annually with data from over 350 million devices. Networks like RapidSOS are already managing smartphone 911 call locations, which according to NENA account for 80% of all 911 calls

In 2015, the founder of 911inform, Ivo Allen, found inspiration for the company after watching news footage of a recent shooting. Unfortunately, this is an issue that's far too prevalent here in the US, but what really struck Ivo was the fact that many of the victims passed away from the inability of emergency first-response teams to arrive on the scene quickly enough. This was due to a variety of factors, but the core reason was the fact that these first responders didn't have the tools available to them to gain a better grasp of the emergency at hand. They had little to no transparency into the emergency and little to no direct communication with those affected by it. They would often be walking into an emergency totally blind, and in an active shooter situation, this is unacceptable. With new technological advancements in safety and security systems, Ivo knew there was a better way. He went to work on the product and after years of testing, 911inform was formally established in 2018.

The idea behind RapidSOS originated in a rural farming community in Indiana, the hometown of founder and CEO, Michael Martin.

After college, Michael chased a career in New York City, only to find himself barely escaping a mugging late one night while walking home. Only a few months later, Michael's father Charlie climbed onto the roof of his childhood home during a major snowstorm, clearing the snow to prevent the roof from caving in.

Charlie fell from the roof, shattering his hip and breaking his wrist. Alone in freezing temperatures and blowing wind, he had no ability to call 911. It wasn't until that evening when Michael's mother Sue came home from work, that she was able to call 911 while frantically trying to warm Charlie's body.

Moved by these personal experiences, Michael spent the next three months cold-calling 911 agencies trying to learn about the challenge. That effort expanded as he attended grad school to develop the concept, working with a growing team out of the Harvard Innovation Lab and MIT Entrepreneurship Center.

Whether he drove 3,000 miles across the country to meet with them, or attended conferences like the National Emergency Number Association (NENA) conference in Tennessee, first responders were eager to help Michael solve this challenge. Again and again, the public safety community would step up to answer millions of questions and test early iterations of RapidSOS technology.

After Eight years and over $100 million of investment, over 5,000 first responders have partnered with RapidSOS to develop the world's first emergency response data platform.
